DELETION OF NAME FROM ELECTORAL ROLL – “OPPORTUNITY OF HEARING IS REQUIRED”

Constitution of India, 1950, Article 226- Representation of People Act, 1950, Sections 22 and 23 – Right to vote – Deletion of name from voter list – Before removing person from voters list electoral registration officer is duty bound to give person concerned reasonable opportunity of being heard in respect of action proposed to be taken – Name of petitioner deleted from voter list despite h is living in particular area and name of his wife and daughter included in list – Direction issued to respondent to conduct detailed enquiry in subject matter and if required take appropriate action against officers who have removed name of petitioner from voters list.
